Agreement to Terms

By accessing or using SafeCheck at safecheck.ai1offs.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. SafeCheck is operated by Montgomery, located in Powell, Wyoming.

Description of Service

SafeCheck provides contractor safety reports based on publicly available OSHA (Occupational Safety and Health Administration) inspection records. We aggregate, organize, and present this public data in a format accessible to homeowners and the general public.

Data Accuracy Disclaimer

SafeCheck sources its data from publicly available OSHA inspection records maintained by the United States Department of Labor. While we make reasonable efforts to keep our data current and accurate, you acknowledge and agree that:

OSHA records may be delayed, incomplete, or contain errors at the source. There may be a lag between when OSHA updates its records and when those updates appear in SafeCheck. A contractor's absence from our database does not mean they have no OSHA history — it may mean they have not been inspected, operate under a different legal name, or that records have not yet been indexed.

SafeCheck does not independently verify OSHA data. We present public records as-is and do not conduct our own workplace safety inspections. Our safety grades are algorithmic assessments based on available data, not professional safety evaluations.

No Guarantee of Contractor Safety

SafeCheck does not guarantee, certify, endorse, or warrant the safety of any contractor. A high safety grade does not guarantee that a contractor will perform safe work. A low safety grade does not necessarily mean a contractor is currently unsafe.

SafeCheck reports are one tool among many that you should use when evaluating a contractor. You are solely responsible for your hiring decisions. We strongly recommend also verifying a contractor's insurance, licenses, references, and any other factors relevant to your project.

SafeCheck is not a substitute for professional safety consulting, legal advice, or your own due diligence.

Payments and Pricing

Certain SafeCheck features require payment. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these terms.

Prices are listed on the Service and may change at any time. Price changes do not affect purchases already completed.

Refund Policy

Full refund for technical failures. If you purchase a report and the Service fails to deliver it due to a technical error on our end, you are entitled to a full refund. Contact us and we will process the refund promptly.

No refund for content. Because SafeCheck reports are generated from public OSHA data and delivered instantly, we do not offer refunds based on dissatisfaction with the content of a report. If a search returns no results for a contractor, that itself is a data point (indicating no OSHA inspections on record) and is considered delivery of the service.

Limitation of Liability

To the maximum extent permitted by applicable law, SafeCheck, its owner, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

In no event shall our total liability to you for all claims arising out of or related to the Service exceed the amount you paid to SafeCheck in the twelve (12) months preceding the claim, with an absolute cap of $9.99 (nine dollars and ninety-nine cents).

This limitation applies regardless of the theory of liability, whether based on contract, tort (including negligence), strict liability, or any other basis, even if SafeCheck has been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless SafeCheck, its owner, and operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these terms, or your reliance on information provided by the Service.

Acceptable Use

You agree not to use SafeCheck to harass, defame, or discriminate against any contractor or individual. You agree not to scrape, crawl, or automatically extract data from the Service. You agree not to resell or redistribute SafeCheck reports without written permission. You agree not to attempt to circumvent rate limits, payment requirements, or other technical safeguards.

Intellectual Property

The SafeCheck name, logo, website design, safety grading algorithm, and original content are the property of SafeCheck and its owner. OSHA inspection data is public domain information maintained by the U.S. government. Our presentation, organization, and analysis of that data is our original work.

Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Park County, Wyoming.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms. If we make material changes, we will make reasonable efforts to notify users.

Termination

We reserve the right to suspend or terminate your access to SafeCheck at any time, for any reason, without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these terms that by their nature should survive termination will survive, including limitation of liability, indemnification, and governing law.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
